M3 SMS Terms
To Opt-In
You have obtained the required permissions from your patients before using M3 SMS. You must receive “express written consent” from patients before sending them messages via M3 SMS. If you text your patients without their explicit permission, it may be considered spam, and you risk facing legal repercussions.
Conforming Opt-In
Once opted-in, your patients will receive an initial test-message from M3 before M3 SMS officially begins its SMS campaign. A patient opting-in will receive a text message via M3 SMS as a confirmation text. Example of confirmation message:
“You opted-in to receive [pick one: weekly or monthly] M3 SMS appointment & balance reminders from [Client Name]. Msg & Data rates may apply. To opt-out, reply, and text “STOP.” Reply & text “OK” to complete your opt-in.”
Stop Instructions (Opt-Out)
Your patients may opt-out of this service at any time by replying to a text message with “STOP.” The opt-out patient will receive confirmation of their opt-out of M3 SMS. Or, they may notify you directly for action. After, M3 will no longer use the service to contact your patient unless the patient decides to rejoin M3 SMS.
Cost to Patient
Message and data rates may apply based on your patient’s wireless plan for both sending and receiving text messages. M3 does not impose a separate fee upon your patient for sending text messages.
Acceptance of Terms
By signing up for M3 SMS, you agree that you have obtained the necessary consent to send and receive text messages to your patients via the M3 SMS. You may opt-out of these communications at any time, and consent to receive text messages. Use of this service should not be a condition of service to your patients.
Additionally, you accept and agree to be bound by these Terms and Conditions, and any other applicable terms and agreements related to your use of M3 SMS. If you do not agree to these Terms and Conditions, you must immediately cease to use M3 SMS.
Program Description
M3 SMS intends to provide patients with information about upcoming appointment reminders and account balances via text.
M3 SMS Content
M3 does not claim ownership of, verify, or control over the content generated, provided or otherwise submitted by you using M3 SMS. You are solely responsible for all content created, and you send (or authorize to be sent) via M3 SMS. M3 and M3 SMS accepts no liability whatsoever for such content. All content you provide is used for the M3 SMS only.
Message Frequency
The number of Company text messages that you receive will vary depending on how many of Company’s text messaging programs for which you sign up to receive messages. You will receive a maximum of three messages per week per Company text messaging program. Company brands generally have separate text messaging programs.
Indemnity
You agree to indemnify M3 in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify M3 when a patient changes their telephone number, including, but not limited to, all related claims, expenses, and damages related to or arising in violation of law.
Privacy
Mobile Network: Access or Delivery
Delivery of information and content to a patient’s mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of M3’s control, and M3 is not responsible or liable for issues arising from them.
Eligibility
To receive text messages via M3 SMS, patients must be a resident of the United States and 18 years of age or older.
Changes to Terms and Conditions
M3 may revise, modify, or amend these Terms and Conditions at any time. Any such revision, modification, or amendment will take effect when posted to M3’s website. You agree to review these SMS Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to send and receive text messages using M3 SMS indicates your acceptance of such revisions, modifications, or amendments.
Compliance
You will abide by these Terms and expressly agree not to use M3 SMS to do anything that violates local, state, or federal law, rules, or regulations as they apply.
M3 Termination of Service
M3 may suspend or terminate your use of M3 SMS if it believes you are in breach of these SMS Terms and Conditions. Your patient’s receipt of text messages via M3 SMS is subject to termination if your patient’s mobile telephone service terminates or lapses. M3 reserves the right to change or discontinue, temporarily or permanently, all or any part of M3 SMS, and M3 may provide notice to you or your patients.
